Sir:

 

     Your Committee on Judiciary, to which was referred S.B. No. 2393, S.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO THE UNIFORM RECOGNITION AND ENFORCEMENT OF CANADIAN DOMESTIC-VIOLENCE PROTECTION ORDERS ACT,"

 

begs leave to report as follows:

 

     The purpose and intent of this measure is to enact the Uniform Recognition and Enforcement of Canadian Domestic-Violence Protection Orders Act.

 

     Your Committee received testimony in support of this measure from two individuals.

 

     Your Committee finds that Canada is the second largest international market for Hawaii and Canadian visitors spend long periods of time in Hawaii during the winter months, with many owning real estate throughout the islands.  Despite this, Canadians with active domestic violence protective orders currently lack sufficient protection while visiting Hawaii.  Your Committee further finds that the Uniform Recognition and Enforcement of Canadian Domestic-Violence Protection Orders Act was developed by the Uniform Law Commission with input from judges and practicing lawyers from both the United States and Canada.  To date, the Uniform Recognition and Enforcement of Canadian Domestic-Violence Protection Orders Act has been enacted in California, Delaware, Minnesota, Nevada, North Dakota, Washington, and Wisconsin.  This measure will protect Canadian travelers who have domestic violence protection orders while they are visiting Hawaii by allowing Hawaii courts and law enforcement agencies to enforce domestic violence protection orders issued by Canadian courts.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 2393, S.D. 1, and recommends that it pass Third Reading.
