     Your Committee on Finance, to which was referred S.B. No. 1260, S.D. 1, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO CRIMINAL PRETRIAL REFORM,"

 

begs leave to report as follows:

 

     The purpose of this measure is to eliminate the use of monetary bail and require defendants to be released on their own recognizance for traffic offenses, violations, nonviolent petty misdemeanor and misdemeanor offenses, and nonviolent class C felony offenses, upon certain conditions and with specified exceptions.

 

     Your Committee received testimony in support of this measure from the Office of the Public Defender; Office of Hawaiian Affairs; Hawaii Correctional System Oversight Commission; Young Progressives Demanding Action; United Public Workers, AFSCME Local 646, AFL-CIO; Common Cause Hawaii; Imua Alliance; Americans for Democratic Action Hawaii; Community Alliance on Prisons; Foresight/Policy Analysis; and numerous individuals.  Your Committee received testimony in opposition to this measure from the Department of the Attorney General, Department of the Prosecuting Attorney of the City and County of Honolulu, Department of the Prosecuting Attorney of the County of Maui, Retail Merchants of Hawaii, and one individual.  Your Committee received comments on this measure from the Judiciary, Hawaii Disability Rights Center, and American Civil Liberties Union of Hawaii.

 

     As affirmed by the record of votes of the members of your Committee on Finance that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1260, S.D. 1, H.D. 1, and recommends that it pass Third Reading.
