Sir:
Your Committee on Health, to which was referred S.B. No. 1186 entitled:
"A BILL FOR AN ACT RELATING TO THE UNIFORM CONTROLLED SUBSTANCES ACT,"
begs leave to report as follows:
The purpose and intent of this measure is to update the Uniform Controlled Substances Act, chapter 329, Hawaii Revised Statutes, to make it consistent with amendments in the federal controlled substances law as required by section 329-11, Hawaii Revised Statutes.
Your Committee received testimony in support of this measure from the Department of Public Safety; Greenwich Biosciences, Inc.; and Akamai Cannabis Clinic.
Your Committee finds that existing law requires that if a substance is added, deleted, or rescheduled under federal law, or by an emergency scheduling action taken by the Department of Public Safety, then the Department is required to recommend that the Legislature make corresponding changes to Hawaii law. Your Committee further finds that the substances listed in this measure correspond to several similar changes to the Drug Enforcement Administration's federally controlled substances schedules. Thus, this measure eliminates the differences between federal and state law.
Your Committee has amended
this measure by making
technical, nonsubstantive amendments for the purposes of clarity and
consistency.
As affirmed by the record of votes of the members of your Committee on Health that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1186, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 1186, S.D. 1, and be referred to your Committees on Judiciary and Ways and Means.
