A BILL FOR AN ACT

 

 

RELATING TO ACADEMIC TENURE AT THE UNIVERSITY OF HAWAII.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature acknowledges that the University of Hawaii fulfills a significant and pivotal role in preparing its students for productive employment and to become engaged citizens of our community.

     The legislature thus supports faculty who teach, engage in research, or provide specialized services and commends the University of Hawaii board of regents for establishing a permitted interaction group on tenure in February 2021 to review and investigate issues of tenure, classification, and periodic faculty review to align with the university's mission and priorities.

     The legislature further finds that the permitted interaction group on tenure submitted its recommendations to the board of regents on September 10, 2021, requesting the adoption and implementation of revisions to the board of regents policy on personnel status, RP 9.201, including faculty and union consultation, but the board of regents has not taken action.

     Accordingly, the purpose of this Act is to:

     (1)  Appropriate funds to the University of Hawaii for the purposes of restoring funding for personal services; and

     (2)  Direct the board of regents and the president of the University of Hawaii to discuss and adopt the recommendations of the permitted interaction group on tenure and to confer with the faculty and the exclusive representative of each applicable collective bargaining unit to implement the permitted interaction group on tenure's recommendations.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $37,951,232 or so much thereof as may be necessary for fiscal year 2022-2023 to restore other personal services, to be allocated to the respective program IDs as follows:

     (1)  University of Hawaii, Manoa (UOH 100), there is allocated the sum of $30,000,000;

     (2)  University of Hawaii, John A. Burns school of medicine (UOH 110), there is allocated the sum of $1,200,000;

     (3)  University of Hawaii, Hilo (UOH 210), there is allocated the sum of $2,280,000;

     (4)  University of Hawaii, West Oahu (UOH 700), there is allocated the sum of $1,080,000; and

     (5)  University of Hawaii, systemwide support (UOH 900), there is allocated the sum of $3,391,232,

or so much thereof as may be necessary for fiscal year 2022‑2023; provided further that the University of Hawaii board of regents and the president of the University of Hawaii shall discuss and adopt the University of Hawaii board of regents' permitted interaction group on tenure's recommendations and consult with the University of Hawaii faculty and the exclusive representative of each applicable collective bargaining unit in implementing the recommendations.

     The sum appropriated shall be expended by the University of Hawaii for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2022.
