A BILL FOR AN ACT
Relating to Water Resources for Development of Affordable Housing.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that one of the most essential factors that must be considered when developing housing is the availability of potable and non-potable water for the residents.
The purpose of this Act is to require the department of land and natural resources' commission on water resource management to conduct a study on the capacity of potable and non-potable water in various regions in the county of Maui to determine whether there is sufficient capacity for the county to expand its affordable housing supply.
SECTION 2. (a) The department of land and natural resources' commission on water resource management shall conduct a study on the capacity of potable and non-potable water in various regions in the county of Maui to determine whether there is sufficient capacity for the county to expand its affordable housing supply.
(b) The study shall include but is not limited to an examination of the following, as it pertains to the county of Maui:
(1) Natural and artificial water resources that are being used or could be used as a source of potable and non-potable water for domestic use;
(2) Water infrastructure, including water systems that are being used or could be used to supply potable and non-potable water for domestic use in various regions of the county;
(3) Volume of potable and non-potable water available for domestic use in various regions of the county;
(4) Current use of potable and non-potable water in various regions of the county;
(5) Projected use of potable and non-potable water in various regions of the county in correlation with the projected population growth in each region;
(6) Analysis and determination for each region with respect to:
(A) Whether there is sufficient water resources, infrastructure, and capacity to support additional residential development; and
(B) What can be done to enable the regions to accommodate additional residential development.
(c) In conducting the study, the commission may consult and seek input from any individual or entity it deems necessary to complete the study, including the department of business, economic development, and tourism's office of planning and sustainable development.
(d) The commission shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2023.
SECTION 3. This Act shall take effect upon its approval.
