A BILL FOR AN ACT

 

 

relating to the uniform information practices act.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 92F, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§92F-    Appointment of responsible officer or employee; reports.  (a)  Each agency shall appoint an officer or employee to be responsible for ensuring that all requests for access to government records for which disclosure is required under section 92F-12 are complied with in a timely manner.

     (b)   The appointed officer or employee for each agency shall prepare a monthly report using forms prescribed by the office of information practices that identifies all requests for access to government records the applicable agency received including:

     (1)  The current status of the agency's response to each request for access to government records;

     (2)  Any good faith basis for its failure to timely disclose records pursuant to a request;

     (3)  The amount of days beyond the deadline that it took for the agency to disclose records pursuant to a request;

     (4)  The contact information for the responsible officer or employee appointed by the agency pursuant to subsection (a); and

     (5)  The contact information for the head of the agency.

     (c)  The monthly report shall be signed by the head of the agency and shall be filed with office of information practices prior to the last day of the month.  The office of information practices shall post all monthly reports on its website."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
