A BILL FOR AN ACT
RELATING TO GOVERNMENT.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
Section 1. The purpose of this Act is to establish two new units within the criminal justice division of the department of the attorney general.
SECTION 2. Chapter 28, Hawaii Revised Statutes, is amended by adding two new parts to be appropriately designated and to read as follows:
"Part
. SPECIAL INVESTIGATION AND PROSECUTION UNIT
§28- Special investigation and prosecution unit.
(a) There is established in the department of the attorney
general a special investigation and prosecution unit. The special investigation and prosecution unit
shall consist of attorneys and other specialized personnel necessary to
implement this section. Each attorney and
specialist shall be appointed by the attorney general who shall fix the attorney's
and specialists' compensation. Every
attorney and specialist shall be entitled to hold the attorney's and
specialist's position during good behavior, subject to removal by the attorney
general only as provided in chapter 76.
(b) The special investigation and prosecution unit
shall:
(1) Receive,
gather, and analyze information;
(2) Develop
tactical and strategic intelligence;
(3) Assist in
control of fraud, white collar crime, and public corruption;
(4) Provide
technical assistance and training to county law enforcement agencies in the
detection and prosecution of fraud and white collar crime; and
(5) Provide, with
the attorney general's approval, specialized personnel and technological
equipment for the use of law enforcement agencies in the State with respect to fraud,
white collar crime, and public corruption.
(c) For purposes of this section, "white collar crime" includes, without limitation, crimes that are financially motivated and are nonviolent or not directly violent crimes that are committed by individuals, businesses, and government professionals.
Part . SEX
AND HUMAN TRAFFICKING UNIT
§28- Sex and Human Trafficking Unit. (a) There is established in the department of the attorney
general a sex and human trafficking unit. The sex and human trafficking unit shall consist
of attorneys and other specialized personnel necessary to implement this
section. Each attorney and specialist
shall be appointed by the attorney general who shall fix the attorney's and specialists'
compensation. Every attorney and specialist
shall be entitled to hold the attorney's and specialist's position during good
behavior, subject to removal by the attorney general only as provided in
chapter 76.
(b) The sex and human trafficking unit shall:
(1) Receive,
gather, and analyze information;
(2) Develop tactical
and strategic intelligence;
(3) Assist in
control of sex and human trafficking crime;
(4) Provide
technical assistance and training to county law enforcement agencies in the
detection and prosecution of sex and human trafficking crime; and
(5) Provide, with the attorney general's approval, specialized personnel and technological equipment for the use of law enforcement agencies in the State with respect to sex and human trafficking crime."
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $834,000 or so much thereof as may be necessary for fiscal year 2022-2023 for the operations of the special investigation and prosecution unit of the department of the attorney general and to establish the following positions within that unit:
(1) Two permanent, full-time equivalent (2.0 FTE) deputy attorney general positions;
(2) Three permanent, full-time equivalent (3.0 FTE) forensic analysist positions;
(3) One permanent, full-time equivalent (1.0 FTE) legal assistant position;
(4) Two permanent, full-time equivalent (2.0 FTE) investigator positions; and
(5) One permanent, full-time equivalent (1.0 FTE) legal clerk position.
The sum appropriated shall be expended by the department of the attorney general for the purposes of this Act.
SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $754,000 or so much thereof as may be necessary for fiscal year 2022-2023 for the operations of the sex and human trafficking unit of the department of the attorney general and to establish the following positions within that unit:
(1) One permanent, full-time equivalent (1.0 FTE) supervising deputy attorney general position;
(2) Two permanent, full-time equivalent (2.0 FTE) deputy attorney general positions;
(3) One permanent, full-time equivalent (1.0 FTE) human trafficking abatement coordinator position;
(4) One permanent, full-time equivalent (1.0 FTE) human services professional position;
(5) Two permanent, full-time equivalent (2.0 FTE) investigator positions;
(6) One permanent, full-time equivalent (1.0 FTE) legal assistant position; and
(7) One permanent, full-time equivalent (1.0 FTE) legal clerk position.
The sum appropriated shall be expended by the department of the attorney general for the purposes of this Act.
SECTION 5. New statutory material is underscored.
SECTION 6. This Act shall take effect on July 1, 2022.
