A BILL FOR AN ACT
RELATING TO CONTRACTORS.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 444-8, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:
"(c) This section shall not prohibit a specialty
contractor from taking and executing a contract involving the use of two or
more crafts or trades[, if] when there are more than two specialty contractors
involved; provided that the performance of the work in the crafts or
trades, other than in which the specialty contractor is licensed, is incidental
and supplemental [to the performance of] and does not exceed five per
cent of the specialty contractor's total work performed in the craft
for which the specialty contractor is licensed."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2050.

Clarifies that a licensed specialty contractor may perform incidental and supplement work in crafts or trades other than in which the specialty contractor is licensed when there are more than two specialty contractors involved; provided that, when measured by the cost and extent of work involved in performing the specialty contract's work, the unlicensed work is limited to five per cent and is only incidental and supplemental to the performance of the work in the craft for which the specialty contractor is licensed.
