A BILL FOR AN ACT

 

 

RELATING TO CONTRACTORS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 444-8, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

     "(c)  This section shall not prohibit a specialty contractor from taking and executing a contract involving the use of two or more crafts or trades[, if]; provided that, when measured by the cost and extent of work involved in executing the specialty contract's work, the performance of the work in the crafts or trades, other than in which the specialty contractor is licensed, is substantially less than and only incidental and supplemental to the performance of work in the craft for which the specialty contractor is licensed."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2050.


 


 

Report Title:

Contractors; Incidental and Supplemental Work; Limit

 

Description:

Clarifies that a licensed specialty contractor may perform incidental and supplement work in crafts or trades other than in which the specialty contractor is licensed; provided that, when measured by the cost and extent of work involved in executing the specialty contract's work, the performance of the unlicensed work is substantially less than and only incidental and supplemental to the performance of work in the craft for which the specialty contractor is licensed.  Effective 7/1/2050.  (SD1)
