A BILL FOR AN ACT
relating to underground fuel storage tanks.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 342L, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:
"§342L- Underground field-constructed tanks. (a) No person shall operate a field-constructed storage
tank.
(b) The department shall not issue new permits or permit
renewals for any field-constructed tank.
As used
in this section,
"Field-constructed
tank" means a tank constructed or manufactured in the field and installed underground.
Types of underground field-constructed tanks
include but are not limited to:
(1) A tank constructed from concrete that is poured in the field; and
(2) Tanks constructed from steel or fiberglass that were fabricated in the field."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
