A BILL FOR AN ACT
relating to accessory dwelling units.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§46- Housing; accessory dwelling units built by non-profits. (a)
Notwithstanding any other law to the
contrary, the counties shall have and may exercise the power to allow an accessory
dwelling unit to be sold or conveyed separately from the primary residence if the
accessory dwelling or the primary dwelling unit was built or developed by a qualified
nonprofit organization.
(b) The appropriate county agency may adopt rules necessary
to carry out the purposes of this section.
(c) For purposes of this section the term "qualified nonprofit organization" shall have the same meaning as defined in section 201H-57."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
