A BILL FOR AN ACT

 

 

RELATING TO TUBERCULOSIS SCREENING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  The department of health and the department's tuberculosis control branch shall amend its administrative rules to classify direct support workers in its developmental disabilities division to be non-licensed, non‑facility based workers, rather than health care facility or residential facility-based workers, for purposes of tuberculosis screenings.

     (b)  Direct support workers in the department of health's developmental disabilities division shall not be subject to any tuberculosis screening or testing requirements in excess of what is required under existing administrative rules for childcare workers, foster care workers, or school personnel in accordance with section 11-164.2-20, Hawaii Administrative Rules.

     (c)  Any tuberculosis screenings required under this section for direct support workers in the department of health's developmental disabilities division may be completed by a symptom screening conducted by the department's tuberculosis control branch or the worker's own health care provider, either by phone, electronic mail, or in person.

     SECTION 2.  This Act shall take effect on January 1, 2050.
