A BILL FOR AN ACT
RELATING TO TRAFFIC VIOLATIONS.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that flags flown from vehicles being operated or moved on streets cause distractions and create unsafe driving conditions. The purpose of this Act is to discourage unsafe practices.
SECTION 2. Chapter 291, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:
"§291- Display of materials affecting safety prohibited. (a) No material that is larger than twelve inches
by eighteen inches in size or which distracts, obstructs the view of, or affects
the safety of other drivers, including but not limited to flags, towels, sheets,
and cloths, shall be displayed on the exterior of any motor vehicle, motorcycle,
motor scooter, bicycle, or moped that is being operated or moved upon any
public street, road, or highway; provided this prohibition shall
not apply to materials used to properly secure cargo or a red flag or cloth required
to be displayed pursuant to section 291-28.
(b) Whoever violates this section shall be fined not more than $50. Each violation shall be deemed a separate offense, and a subsequent violation of the same provision within a one‑year period shall be subject to twice the fine imposed upon the prior conviction therefor."
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect on January 1, 2050.
