A BILL FOR AN ACT
RELATING TO ILLEGAL GAMBLING.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 712-1221, Hawaii Revised Statutes, is amended by amending subsection (1) to read as follows:
"(1) A person commits the offense of promoting gambling in the first degree if the person knowingly advances or profits from gambling activity by:
(a) Engaging in bookmaking to the extent that the person receives or accepts in any seven-day period more than five bets totaling more than $500;
(b) Receiving in connection with a lottery, or
mutuel scheme or enterprise, money or written records from a person other than
a player whose chances or plays are represented by such money or records; [or]
(c) Receiving or having become due and payable in
connection with a lottery, mutuel, or other gambling scheme or enterprise, more
than $1,000 in any seven-day period played in the scheme or enterprise[.];
or
(d) Engaging in hosting activities that advance
gambling activity on real property, including organizing or promoting gambling activities,
receiving or entertaining others engaging in gambling, or providing services and
resources to others who are engaging in gambling."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
