A BILL FOR AN ACT
RELATING TO DIETITIAN LICENSURE SPECIAL FUND.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to remove the statutory spending ceiling for the dietitian licensure special fund and establish the ceiling through the state budget process to allow for retention of special funds and reduce dependence on the general fund.
SECTION 2. Section 448B-10, Hawaii Revised Statutes, is amended to read as follows:
"§448B-10 Dietitian licensure special fund. (a) There is established in the state treasury a special fund to be known as the dietitian licensure special fund to be administered by the department. Fees collected under section 448B-9 shall be deposited in the dietitian licensure special fund and may be expended for costs associated with administering the licensure program, including but not limited to education.
[(b) Not more than $30,000 of the dietitian
licensure special fund may be used during any fiscal year for activities
associated with administering the licensure program including the costs
associated with administering the licensure program.
(c) Any amount in the
dietitian licensure special fund in excess of $35,000 on June 30 of each fiscal
year shall be deposited into the general fund.
(d)] (b) The department shall submit a report to the
legislature concerning the status of the dietitian licensure special fund,
including deposits to and expenditures from the dietitian licensure special
fund and the sources of receipts and uses of expenditures, no later than twenty
days prior to the convening of each regular session."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
