A BILL FOR AN ACT
RELATING TO PROCUREMENT.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to allow cost competitiveness in the procurement of certain professional services by allowing any selection committee that evaluates an engineering, architectural, surveying, or landscape architectural professional service submittal for a state or county contract to require the top ranked competing professional service offerors to submit cost or pricing data on their respective proposals.
SECTION 2. Section 103D-304, Hawaii Revised Statutes, is amended by amending subsection (g) to read as follows:
"(g) The selection committee shall rank a minimum
of three persons based on the selection criteria in subsection (e) and
send the ranking to the head of the purchasing agency[.]; provided that
with respect to engineering, architectural, surveying, or landscape architectural
professional services for state or county contracts under this section, the selection
committee may require the top ranked competing professional service offerors to
submit cost or pricing data on their respective proposals to be provided to the
head of the purchasing agency for consideration in contract negotiations under subsection
(h); provided further that the purchasing agency is not required to disclose competing
cost or pricing data to any party.
The contract file shall contain a copy of the summary of qualifications
for the ranking of each of the persons provided to the head of the purchasing
agency for contract negotiations. If
more than one person holds the same qualifications under this section, the selection
committee shall rank the persons in a manner that ensures equal distribution of
contracts among the persons holding the same qualifications. The recommendations of the selection committee
shall not be overturned without due cause."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2021.
