A BILL FOR AN ACT

relating to the university of hawaii.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the stated mission of the University of Hawaii at Manoa's athletic department is to operate dynamic sports programs encouraging student-athletes in their pursuit of excellence in the realms of academic achievement and athletic competition at the highest levels. While the athletic department has produced skilled talent and provided quality sports entertainment for fans and the community, there are concerns about the quality of the athletic facilities and other inadequacies of the department. Therefore, a management and financial audit would serve to improve the athletic department and restore the public's confidence in its ability to carry out its mission.

The purpose of this Act is to require and appropriate funds for the office of the auditor to perform a management and financial audit of the University of Hawaii at Manoa's athletic department and submit a report of its findings and recommendations to the legislature.

SECTION 2. (a) The auditor shall perform a management and financial audit of the University of Hawaii at Manoa's athletic department.

(b) The management and financial audit shall include, at a minimum:

(1) A determination of whether the University of Hawaii at Manoa's athletic department is currently fulfilling its mission;

(2) A review of accountability within the athletic department;

(3) An analysis of the athletic department's budget and whether the expenditure of its funds is in accordance with its original purpose;

(4) An examination of procurement procedures of the athletic department; and

(5) Any and all other matters that the auditor would normally undertake as necessary or appropriate in a management or financial audit.

(c) The board of regents of the University of Hawaii, president of the University of Hawaii, their staff, and other relevant persons or agencies shall cooperate with and assist the auditor and shall provide the information requested by the auditor to fulfill the legislature's request.

(d) The auditor shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2023.

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2022-2023 for the auditor to conduct a management and financial audit of the University of Hawaii at Manoa's athletic department.

The sum appropriated shall be expended by the office of the auditor for the purposes of this Act.

SECTION 4. This Act shall take effect on July 1, 2022.
