A BILL FOR AN ACT
relating to motor carriers.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 271-36, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) Every common carrier by motor vehicle and
every contract carrier by motor vehicle shall pay to the commission, in April
of each year, a fee equal to one-fourth of one per cent of the gross revenues
from the carrier's business during the preceding calendar year, or the sum of
$20, whichever is greater[.]; provided that for a common carrier by motor
vehicle that is a tour bus operator or a contract carrier by motor vehicle that
is a tour bus operator, the fee shall be equal to 2.5 per cent of the gross revenues
from the tour bus operator's business during the preceding calendar year, or the
sum of $20, whichever is greater.
Gross revenues include all revenues received from services connected
with or incidental to the transportation of persons or the transportation of
property, as defined under section 271-4.
For the purposes of this subsection:
"Tour bus" means a bus used
for the purpose of transporting persons for pleasure or sightseeing trips; or transporting
persons to pleasure or sightseeing cruises or destinations. "Tour bus" does not include a bus used
solely for the purposes of transporting individuals to and from a place of work
or a public or private school or solely for the purpose of transporting persons
with disabilities.
"Tour bus operator" means a person who owns, manages, or dispatches tour buses."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
