A BILL FOR AN ACT
relating
to coastal erosion.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. (a) The university of Hawaii shall establish and implement a two-year program to study the impact of sandbag walls, often referred to as "sand burritos," on sand movement patterns and coastal erosion at Ehukai beach park.
(b) The university of Hawaii shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2024.
SECTION 2. Notwithstanding any law to the contrary, between July 1, 2022, and December 31, 2024, no homeowner in the State shall install or use a sandbag wall or "sand burrito" unless authorized by an emergency permit from the department of land and natural resources.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2022-2023 to study the impact of sandbag walls or "sand burritos" on sand movement patterns and coastal erosion at Ehukai beach park.
The sum appropriated shall be expended by the university of Hawaii for the purposes of this Act; provided that the moneys appropriated by this Act shall not lapse at the end of the 2022-2023 fiscal year; provided further that any moneys that remain unencumbered on June 30, 2024, shall lapse on that date.
SECTION 4. This Act shall take effect on July 1, 2022.
