A BILL FOR AN ACT
MAKING AN EMERGENCY APPROPRIATION TO THE DEPARTMENT OF EDUCATION FOR LEAD ABATEMENT.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. This Act is recommended by the governor for immediate passage in accordance with section 9 of article VII of the Constitution of the State of Hawaii.
SECTION 2. In providing a safe educational space for students to learn, the department of education strives to ensure that its facilities are maintained to protect the health and safety of its students, teachers, and staff. According to the United States Environmental Protection Agency, there is no known safe level of lead in a child's blood and lead is harmful to health, especially for children.
Results of the recently completed first phase of a United States Environmental Protection Agency's, Water Infrastructure Improvements for the Nation Act grant programs found department of education elementary schools in Hawaii with old plumbing fixtures that are resulting in trace amounts of lead being found in drinking water sources.
The purpose of this Act is to appropriate funds for fiscal year 2021-2022 for lead abatement measures to repair or replace plumbing fixtures shown to have more than five parts per billion lead at department of education elementary schools.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $1,850,000 or so much thereof as may be necessary for fiscal year 2021-2022 for the purpose of the lead abatement measures.
The sum appropriated shall be expended by the department of education.
SECTION 4. This Act shall take effect upon its approval.
