A BILL FOR AN ACT
RELATING TO HAWAII PRODUCTS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 103D-1002, Hawaii Revised Statutes, is amended by amending subsection (i) to read as follows:
"(i) This section shall not apply [whenever its]
when at least one of the following conditions is met:
(1) Its
application will disqualify any governmental agency from receiving federal funds
or aid[.]; or
(2) The solicitation is for construction."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2112.

Exempts construction procurements from the provisions in the Hawaii public procurement code that incentivize contractors and subcontractors to use Hawaii products. Effective 7/1/2112. (HD1)
