A BILL FOR AN ACT

 

 

RELATING TO THE ALA WAI BOAT HARBOR.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the Ala Wai boat harbor is an important location for the State, serving as the largest small boat and yacht harbor in Hawaii.  The Ala Wai boat harbor has endured the impacts of numerous vessels that have berthed in its docks and of many residents and visitors who have walked the harbor's paths to view boats sail in the surrounding waters, and the harbor is now in need of extensive repairs.

     The legislature further finds that many efforts were made to repair and redevelop the Ala Wai boat harbor.  In 2019, the department of land and natural resources' division of boating and ocean recreation placed a request for proposals to redevelop the Ala Wai boat harbor.  However, only a few proposals were submitted, and the proposals that were submitted were rejected by the division's selection committee.  The division is working toward a new process to provide for the redevelopment of the Ala Wai boat harbor, but repair work is needed immediately to ensure the harbor remains an attractive and safe area for Hawaii's residents and visitors.

     The purpose of this Act is to provide the division of boating and ocean recreation of the department of land and natural resources with greater flexibility to fund necessary repairs and construction at Ala Wai boat harbor.

     SECTION 2.  Section 103-7, Hawaii Revised Statutes, is amended to read as follows:

     "§103-7  Capital improvements; authorizations for; emergency repairs or reconstruction, exception.  All capital improvement projects requiring the use of general funds, special funds, general obligation bonds, and revenue bonds of the State, except projects covered by chapter 41D, shall require authorization by the legislature and the governor[.]; provided that capital improvement projects for Ala Wai boat harbor shall not require authorization by the legislature and the governor."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2050.
