A BILL FOR AN ACT

 

 

relating to peer-to-peer car sharing.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part XII to be appropriately designated and to read as follows:

     "§291C-     Peer-to-peer car-sharing; prohibited.  (a)  No person shall operate, use, or control a peer-to-peer car-sharing program in the State.

     (b)  For the purposes of this section, "peer-to-peer car‑sharing program" means a business platform that connects vehicle owners with drivers to enable the sharing of vehicles for financial consideration.  "Peer-to-peer car-sharing program" does not mean lessor as defined in section 437D-3.  "Peer‑to‑peer car-sharing program" is not a car-sharing organization as defined in section 251-1."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
