A BILL FOR AN ACT

RELATING TO THE DEPARTMENT OF LAND AND NATURAL RESOURCES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. (a) The department of land and natural resources shall lease, as is, the property located at 29-169 Kulaiwi Road (also known as the old Hakalau school site) located in south Hilo on Hawaii island (TMK (3) 2-9-002:005) to the Wailea Village Historic Preservation Community for a period of twenty years.

(b) The lease rent shall be $           per year, to be deposited to the general revenues of the State of Hawaii.

(c) During the period of the lease, the Wailea Village Historic Preservation Community shall:

(1) Provide adequate insurance for the property;

(2) Accept all liability for the property; and

(3) Accept all responsibility for any necessary mitigation of the property for hazardous waste.

(d) The lease shall begin on July 1, 2021, and shall terminate on June 30, 2041.

SECTION 2. This Act shall take effect on January 1, 2050.
