RELATING TO THE FESTIVAL OF PACIFIC ARTS. Extends the date on which the temporary commission on the thirteenth festival of pacific arts shall cease to exist to August 31, 2025. Permits less than a quorum of commission members to discuss matters relating to official board business outside a commission meeting as a permitted interaction under part I of chapter 92, Hawaii Revised Statutes, to enable them to perform their duties faithfully, provided that the commission holds a meeting at least once a month and discusses the progress of the permitted interaction matter at the next meeting. RELATING TO BOTTLED WATER. Updates the federal law reference to standards established by the United States Food and Drug Administration regarding product quality standards for bottled water. Repeals the requirement that noncarbonated bottled water be transported, stored, processed, or bottled through lines or equipment through which only water is passed. Effective 1/1/2050. (HD1)

RELATING TO THE BROWNFIELDS CLEANUP REVOLVING LOAN FUND. Enables use of moneys in the brownfields cleanup revolving fund for subgrants to eligible entities for assessment and cleanup of brownfields sites and certain site monitoring activities. (SD2)

RELATING TO COMMUNITY DEVELOPMENT. Requires the Hawaii community development authority to develop a transit-oriented development zone improvement program. Amends the membership of the authority for matters affecting transit-oriented development zones. Authorizes the Hawaii community development authority to establish transit-oriented development zones for lands within county-designated transit-oriented development zones or within a one-half mile radius around fixed transit stations. Effective 7/1/2050. (HD2)

RELATING TO THE HAWAII CIVIL RIGHTS COMMISSION. Clarifies the meaning of "program or activity receiving state financial assistance". Excludes cases within the scope of the Individuals with Disabilities Education Act from the jurisdiction of the Hawaii civil rights commission. Effective 12/25/2040. (HD1)

RELATING TO CRIMINAL HISTORY RECORD CHECKS. Adds the University of Hawaii to the list of agencies that are authorized to conduct criminal history record checks on current or prospective employees, whose positions or duties are related to the security of campus facilities and persons. (SD1)

RELATING TO EMERGENCY POWERS. Prohibits the governor or the mayor from suspending requests for public records or vital statistics during a declared state of emergency. Effective 7/1/2050. (HD1)

RELATING TO TELEHEALTH. Authorizes the establishment of a physician-patient relationship via a telehealth interaction if the physician is licensed to practice medicine in the State. Effective 7/1/2050. (HD1)

RELATING TO THE CORONAVIRUS 2019 PANDEMIC. Appropriates moneys. Exempts any person from the post-arrival mandatory self‑quarantine if the person receives a negative test result prior to arrival. Allows the governor to establish statewide conditions for exemption. Requires certain COVID-19 tests for travelers who do not have a test result upon arrival to avoid mandatory self-quarantine. Requires any person who does not obtain a negative test result for COVID-19 pre-arrival to be responsible for all costs associated with that person's mandatory self-quarantine. Prohibits the suspension of the quarantine requirements except by legislative approval via a concurrent resolution. Repeals quarantine requirements on 12/31/2021. Requires that should any project or program related to COVID-19 response efforts paid for by state funds later become eligible for federal reimbursement, those federal funds shall be deposited into the general fund. Lapses funds from the major disaster fund to the general fund on 7/1/2021. Effective 7/1/2050. (HD1)

RELATING TO TRANSPORTATION. Requires the department of transportation to report on the complete streets policy and principles. Requires the department of transportation to establish standards relating to safe travel along state roadways and a complete streets checklist. Requires the director of transportation to provide training for maintenance staff in complete street policies, principles, and implementation procedures. Requires counties to consider complete street policies when adopting or amending land use ordinances. Effective 5/6/2137. (HD2)

RELATING TO TRANSPORTATION. Requires the department of transportation to create motor vehicle, bicycle, and pedestrian highway and pathway networks. Creates annual reporting requirements. Effective 7/1/2050. (HD1)

RELATING TO VEHICLE INSPECTIONS. Codifies certain certification, renewal, and violation processes of vehicle inspectors who conduct vehicle safety inspections under the department of transportation. Repeals the requirement for reconstructed vehicles to obtain a special inspection and certification on 1/1/2022 and reenacts the requirement on 7/31/2025. Requires the department of transportation to submit a report on the effects of the repeal no later than twenty days prior to the convening of the regular session of 2025. Effective 7/1/2040. (HD2)

RELATING TO RENTALS FOR PUBLIC LAND LEASES. Authorizes the board of land and natural resources to approve rental reductions or waivers for leases on public lands that require substantial demolition or infrastructure improvement costs for the lessee to utilize the premises. Sunsets 6/30/2026. (HD2)

RELATING TO FOREST STEWARDSHIP. Clarifies conditions that must be met by applicants to receive funds under the forest stewardship program administered by the board of land and natural resources. (SD2)

RELATING TO STATE SMALL BOAT HARBOR FEES. Changes the criteria for calculating the various fees that the department of land and natural resources may charge for the usage of state small boat harbors, including requiring that certain state small boat harbor fees be set at fair market value, and how certain fees are applied. RELATING TO VESSELS. Clarifies removal processes for unauthorized vessels. Clarifies the criteria for determining whether a vessel is abandoned. Reduces the allowable time frame to claim an unauthorized vessel that is impounded by the department of land and natural resources from thirty days to ten working days. Reduces the allowable time frame to claim an abandoned vessel that is impounded by a state or county agency from twenty days to ten working days. Makes abandonment of a vessel in the waters of the State or public property a petty misdemeanor. Clarifies auction requirements regarding abandoned vessels. Allows the department of land and natural resources to charge an impound storage fee. Effective 1/1/2050. (HD1)

RELATING TO SPORT FISH. Requires the division of aquatic resources of the department of land and natural resources to establish a pilot project to restock the Wahiawa public fishing area with northern largemouth bass, butterfly peacock bass, or both, by 1/1/2023. Effective 1/1/2050. (HD2)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, remote testitfiers' written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
