RELATING TO ELECTIONS. Allows the elections commission to refer a complaint to the attorney general or county prosecutor in addition to any administrative determination and without the requirement that the commission believes the respondent has recklessly, knowingly, or intentionally committed a violation. Disqualifies a person convicted of violating elections criminal prosecution laws from holding elective public office for ten years, rather than four. Repeals language stipulating that elections criminal prosecution law does not apply to any person who has paid or agreed to pay fines related to report filing violations and advertisement violations prior to the commencement of the proceedings.

Authorizes the courts to enter into agreements to divert into residential, rehabilitative, and other treatment those defendants whose physical or mental disease, disorder, or defect is believed to have become or will become an issue in a judicial case. Requires either one psychiatrist or one psychologist to be appointed in felony cases requiring three examiners. Requires an examination for penal responsibility to be conducted within fifteen days after a finding of fitness to proceed. Effective 7/1/2050. (HD1)

RELATING TO THE ADMINISTRATION OF JUSTICE. Amends the effect of finding a defendant charged with a misdemeanor or petty misdemeanor not involving violence or attempted violence unfit to proceed. RELATING TO NON-GENERAL FUNDS. Reclassifies the antitrust trust fund, notaries public revolving fund, and criminal forfeiture revolving fund as special funds; litigation deposits trust fund as a trust account; and the national mortgage settlement trust account as a trust fund. Abolishes the criminal justice commission trust account.

RELATING TO CHILD ABUSE REPORTING. Adds members of the clergy, commercial computer technicians, and commercial film, and photographic print or image processors to the categories of persons who are required to report child abuse and neglect to DHS or police. Provides a "safe harbor" through December 31, 2020, for reporting by clergy of known or suspected child abuse that was previously unreported and that did not arise during a penitential communication. Takes effect on 12/31/2059. (HD1)

RELATING TO SPECIAL IMMIGRANT JUVENILE STATUS. Specifies that the family court has jurisdiction in proceedings concerning the custody or guardianship of an immigrant child pursuant to a motion for Special Immigrant Juvenile factual findings requesting a determination that the child was abused, neglected, or abandoned before the age of 18. RELATING TO THE ADMINISTRATION OF JUSTICE. Limits DOH commitment to one hundred eighty days for those defendants charged with a non-violent class C felony and found to be unfit to proceed under chapter 704, HRS. Limits to one hundred eighty days the period of conditional release granted to defendants charged with a non-violent class C felony. Effective 7/1/2050. (HD1)

RELATING TO THE TRAFFIC CODE. Amends the statewide traffic code to allow for the chairperson of the BLNR and county chiefs of police to designate state or county employees or contractors to issue citations for traffic violations. Takes effect on 7/1/2050. (HD1)

RELATING TO THE HAWAII CIVIL RIGHTS COMMISSION. Clarifies the meaning of "program or activity receiving state financial assistance". RELATING TO MOTOR VEHICLE REGISTRATION. Provides that any authorization by a county director of finance for an electronic method of motor vehicle registration, including the acceptance of any supplemental documents in electronic form, shall extend to all types of motor vehicles. RELATING TO MENTAL HEALTH. Broadens the term of "imminently dangerous to self and others" to persons who will likely be dangerous within the next ninety days, rather than within the next forty-five days. Increases the maximum period of emergency hospitalization from forty-eight hours to seventy-two hours. Effective 12/31/2059. (HD1)

RELATING TO MONETARY OBLIGATIONS. Prohibits the imposition of restrictions on a person's ability to obtain or renew a driver's license or to register, renew the registration of, or transfer or receive title to a motor vehicle, as a consequence of unpaid monetary obligations. Does not affect driver's license suspensions related to excessive speeding, lack of motor vehicle insurance, or non-compliance with a child support order. Effective July 1, 2050. (HD1)
