Status

RELATING TO PROTECTIVE ORDERS.

Permits a law enforcement officer to search a person convicted of violating certain temporary restraining orders or protective orders, including the person's motor vehicle and the person's residence, for firearms without obtaining a search warrant if the law enforcement officer has reason to believe acts of abuse, malicious property damage, or harassment by the person are imminent.  Specifies that a seized firearm shall not be used for a subsequent conviction if the original search lacked probable cause but authorizes law enforcement to maintain the firearm until the registered owner can prove the firearm will be safely stored.

Status

RELATING TO FIREARMS.

Prohibits certain individuals who, as a minor, were diagnosed with behavioral, emotional, or mental disorders or adjudicated by the family court to have committed a certain number of crimes of violence from owning firearms unless the person has been medically documented to be no longer either adversely affected by the behavioral, emotional, or mental disorder or deemed a danger to themselves or others.  Requires records of these diagnoses or adjudications to be made available to law enforcement officials.

Status

RELATING TO THE UNIFORM PROBATE CODE.

Requires a personal representative of a decedent appointed under the Uniform Probate Code to notify the police department of the appropriate county of any and all firearms in an estate.  Requires the police department to certify that all firearms in an estate are properly transferred or disposed of before the estate may close.

Status

RELATING TO FIREARMS.

Repeals provisions that allow the lending of certain firearms for use within the State for up to 15 days and for use outside the State for up to 75 days without being subject to a background check and other requirements under chapter 134, HRS.  Prohibits transferring the possession or ownership of any firearm to any person except as provided under chapter 134, HRS.

Status

RELATING TO FIREARMS.

Extends the prohibition for large capacity magazines to all firearms, rather than just pistols.  Provides an exception to the prohibition for law enforcement agencies and duly authorized officers.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony should indicate:

·    Testifier's name with position/title and organization;

·    The Committee(s) to which the comments are directed;

·    The date and time of the hearing; and

·    Measure number.

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.
