Repeals provision that allows persons designated as covered offenders in another state or jurisdiction to petition the Attorney General for termination of registration requirements upon demonstrating that the out of state convictions are not covered offenses in the State of Hawaii.  (SD1)

Includes coercion as a means of committing the offense of sex trafficking.  Removes the criminal statute of limitations for sex trafficking and promoting prostitution.  Specifies that sex trafficking of a minor is a strict liability offense.  Repeals the offense of solicitation of a minor for prostitution.  (SD1)

Authorizes manslaughter prosecutions of persons who cause the death of another person by recklessly operating a motor vehicle with .08 or more grams of alcohol per two hundred ten liters of breath or .08 or more grams of alcohol per one hundred milliliters or cubic centimeters of blood.  (SD1)

Amends the offense of theft in the second degree to include theft of property commonly used to store items of personal or monetary value, including any purse, handbag, or wallet.

Amends the effect of finding a defendant charged with a misdemeanor or petty misdemeanor not involving violence or attempted violence unfit to proceed.  Amends the requirements for fitness determination hearings, court-appointed examiners, and examination reports.  Effective 7/1/2050.  (SD1)

Status

RELATING TO THEFT.

Establishes the offense of theft of catalytic converter as a class C felony.  Defines "catalytic converter."  Requires scrap dealers to follow the same requirements regarding a written statement for the purchase of palladium, platinum, rhodium, and a scrap catalytic converter from which some or all of the catalyst metals have been removed as is required for the purchase of copper, beer kegs, and urns.  (SD1)

RELATING TO CAMPAIGN FINANCE.

Increases the maximum amount of public funds available in each election to certain state candidates by 10% annually.  Increases the amount of voluntary state income tax check-off contributions that may be designated for the Hawaii election campaign fund beginning on 1/1/2021.  Effective 7/1/2050.  (SD2)

RELATING TO ORDERS OF THE CAMPAIGN SPENDING COMMISSION.

Provides that the right to a contested case hearing is deemed waived if a person does not request a hearing within 30 days of receipt of the commission's preliminary determination.  Permits an order of the commission to be confirmed as a judgment in the circuit court, giving the order the same force and effect as any other judgment issued by the circuit courts; provided that there shall be no appeal from the judgment.  (SD1)

RELATING TO EQUAL ACCESS TO PUBLIC CONVENIENCES.

Requires that restrooms and toilet facilities of public amusement facilities constructed, renovated, retrofitted, or installed after 1/1/2021 have 2 female-use toilets for each male-use toilet or urinal.

RELATING TO INTOXICATING LIQUOR.

Requires the liquor commission to record all complaints against any licensee, regardless of whether the complaint is filed during or after the occurrence of the violation.  Requires the liquor commission to review the history of complaints against any applicant at the time of application for a new license or renewal of an existing license.  Takes effect 6/18/2050.  (SD1)

Status

RELATING TO BOARD MEMBERS.

Proposed HD1:  Permits 2 or more members of a board to attend state of the city, state of the county, state of the State, or state of the judiciary addresses; provided that the board members do not discuss board business and no commitment to vote is made or sought.  Authorizes boards to exclude the public from the meeting locations where board members are physically present if the board meetings are held by interactive conference technology during a state of emergency due to a contagious illness. (SB2038 HD1 PROPOSED)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony should indicate:

·    Testifier's name with position/title and organization;

·    The Committee(s) to which the comments are directed;

·    The date and time of the hearing; and

·    Measure number. 

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

WEB:    For testimony less than 20MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.
