MAKING AN EMERGENCY APPROPRIATION TO THE STATE PUBLIC CHARTER SCHOOL COMMISSION. Makes an emergency appropriation to provide funds for the state public charter school commission to pay the claim and settlement amount pursuant to Miller-Potter v. State of Hawaii, et al., Civil No. 16-1-0385K. Effective 7/1/2050. (SD1)

RELATING TO LEGAL SERVICES FOR LOW-INCOME IMMIGRANTS. Appropriates funds to the Department of Labor and Industrial Relations, Office of Community Services to contract with non‑profit service providers for legal counsel to assist and represent low—income immigrants in immigration proceedings and immigrant status issues. Appropriates funds. Effective 7/1/2050. (SD2)

RELATING TO CIVIL IDENTIFICATION CARDS. Repeals the minimum age requirement to obtain a civil identification card in the State.

RELATING TO SPORTS OFFICIALS. Allows the court to enjoin a defendant from attending any sports event of the type at which the offense occurred for up to twelve months when convicted of certain assault or terroristic threatening and the victim of the offense is a sports official engaged in the lawful discharge of the sports officials' duties. RELATING TO DIVORCE. Grants exclusive original jurisdiction in matters of annulment, divorce, and separation and other certain cases to the family court of the circuit in which an applicant is domiciled at the time the application is filed. Repeals the requirement that a person be domiciled or physically present in the State for a continuous period of at least three months before filing for divorce. Repeals the requirement that a person be domiciled or physically present in the State for a continuous period of at least six months before completing a divorce.

RELATING TO JUDICIAL ENFORCEMENT OF THE UNIFORM INFORMATION PRACTICES ACT. Clarifies and expands procedural requirements for judicial review of an agency's denial of access to a government record. Provides procedural requirements and standards of review upon appeal. (SD1)

RELATING TO PROTECTIVE ORDERS. Establishes a Hawaii Hope Card Program within the Department of the Attorney General to issue cards verifying a person's long-term protective order. Appropriates funds. Effective 7/1/2050. (SD2)

RELATING TO THE PENAL CODE. Requires the Judicial Council to conduct a comprehensive review of the penal code and to recommend proposed changes. Requires the Judicial Council to appoint an advisory committee to assist in the review, and allows the Council to also appoint a reporter and other staff as necessary. Requires the advisory committee to report to the Legislature. Makes an appropriation. Effective 7/1/2050. (SD2)

RELATING TO LAW ENFORCEMENT STANDARDS BOARD. Clarifies membership and certain powers and duties of the Law Enforcement Standards Board. Establishes deadlines for the completion of board responsibilities. Appropriates funds to enable the board to accomplish its mission. Effective 7/1/2050. (SD2)

RELATING TO OFFENSES AGAINST PROPERTY RIGHTS. Establishes the offense of unauthorized control of propelled vehicle in the second degree, which applies if a person recklessly or negligently exerts unauthorized control over another's propelled vehicle by operating the vehicle without the owner's consent or by changing the identity of the vehicle without the owner's consent. RELATING TO THE DEFINITION OF PROPERTY. Updates the definition of "property" to expressly include intellectual property for purposes of prosecuting property crimes. Defines "intellectual property." (SD1)

RELATING TO DISORDERLY CONDUCT. Amends the offense of disorderly conduct to include engaging in conduct with intent to convey false or misleading information.

RELATING TO VIOLATION OF PRIVACY. Excludes violation of privacy in the first degree, and certain paragraphs of violation of privacy in the second degree, from qualifying for deferred acceptance of guilty plea or nolo contendere plea.

RELATING TO LITTERING. Increases the maximum civil penalty for littering from $500 to $1,000. Increases the maximum fine for the offense of criminal littering from $1,000 to $5,000.

RELATING TO THE PENAL CODE. Establishes the offense of unauthorized attachment of an object to a fence, gate, wall, or other structure, which is committed when a person knowingly attaches an object to a fence, gate, wall, or other structure or barrier without the owner's permission. (SD1)

RELATING TO WILDLIFE OFFENSES. Provides that all animal parts, products, or items containing prohibited animal parts or products involved in the commission of wildlife trafficking or certain hunting offenses shall be considered contraband to be forfeited to and disposed of by the State. (SD1)

RELATING TO NOTARIAL ACTS. Updates laws concerning notaries public to conform to the Revised Uniform Law on Notarial Acts (2018), the Hawaii Uniform Electronic Transactions Act, other state notary laws, and current notary practices. Effective 7/1/2021. (SD2)
