RELATING TO WITNESS FEES AND REIMBURSEMENTS IN CRIMINAL CASES. Clarifies applicable reimbursement to State or defendant for expert witness fees, as it pertains to testimony, preparation, and in-court attendance in state court criminal proceedings.

RELATING TO EYEWITNESS IDENTIFICATION. Amends Act 281, Session Laws of Hawaii 2019, to provide clarification and flexibility in eyewitness identification procedures.

PROPOSING AMENDMENTS TO ARTICLE V OF THE CONSTITUTION OF THE STATE OF HAWAII TO AUTHORIZE LEGISLATION REGARDING THE PROCESS BY WHICH CRIMINAL REPRIEVES, COMMUTATIONS, AND PARDONS ARE SUBMITTED TO AND CONSIDERED BY THE GOVERNOR. Proposes amendments to the Constitution of the State of Hawaii relating to the authorization of legislation governing the process by which executive reprieves, commutations, and pardons are submitted to and considered by the governor.

RELATING TO ORDERS OF THE CAMPAIGN SPENDING COMMISSION. Provides that the right to a contested case hearing is deemed waived if a person does not request a hearing within 20 days of receipt of the commission's preliminary determination. Permits an order of the commission to be confirmed as a judgment in the circuit court, giving the order the same force and effect as any other judgment issued by the circuit courts; provided that there shall be no appeal from the judgment.

RELATING TO DRUG DISPOSAL. Establishes the Drug Disposal Program, administered by the Department of the Attorney General, to dispose of prescription and over-the-counter drugs in a safe, secure, and environmentally friendly manner. Establishes the Drug Disposal Special Fund and appropriates funds.

RELATING TO SEXUAL ASSAULT. Amends the offenses of sexual assault in the first and third degree, when perpetrated against someone who is mentally defective, to remove the standard of proof regarding knowledge that the other person was mentally defective, as that term is defined in section 707-700, Hawaii Revised Statutes.

RELATING TO ABUSE OF A FAMILY OR HOUSEHOLD MEMBER. Amends the penal code to add abuse of a family or household member to felonies that qualify for repeat offender sentencing.

RELATING TO DOMESTIC VIOLENCE. Allows a narrow hearsay exception for statements made by domestic violence victims to certain government officials within 24 hours of an incident of domestic violence, even if the statement is testimonial in nature, as long as the statement bears sufficient indicia of reliability.
