RELATING TO SEXUAL ASSAULT EVIDENCE COLLECTION KITS. Changes the deadline for the counties to adopt and utilize electronic tracking systems for sexual assault evidence collection kits.

RELATING TO MINORS. Requires members of the clergy to report child abuse and neglect to the Department of Human Services or to the police. Specifies that the general rule of privilege under the Hawaii Rules of Evidence for confidential communications made to a member of the clergy does not apply to communications relating to child abuse or neglect.

RELATING TO SEXUAL ASSAULT. Amends the offenses of sexual assault in the first and third degree, when perpetrated against someone who is mentally defective, to remove the standard of proof regarding knowledge that the other person was mentally defective, as that term is defined in section 707-700, Hawaii Revised Statutes.

RELATING TO SEX OFFENDERS. Classifies as first-degree sexual assault the sexual penetration of a child under 12 by a person 18 or older and mandates a 10-year minimum term of imprisonment without the possibility of parole. Establishes residency restrictions for persons who must register as a sex offender or offender against minors pursuant to Chapter 846E, HRS.

RELATING TO CHILDHOOD SEXUAL ABUSE. Amends statutory limitations on the time period in which a survivor of childhood sexual abuse may file a civil suit. Provides that the monetary relief under this section shall not include punitive damages. Permits the court to order restorative justice measures, if deemed appropriate.

RELATING TO ABUSE OF A FAMILY OR HOUSEHOLD MEMBER. Amends the penal code to add abuse of a family or household member to felonies that qualify for repeat offender sentencing.

RELATING TO DOMESTIC ABUSE. Provides that a court may not grant more than 2 continuances of an order to show cause hearing in domestic abuse cases, absent a finding of exigent circumstances.

RELATING TO DOMESTIC VIOLENCE. Allows a narrow hearsay exception for statements made by domestic violence victims to certain government officials within 24 hours of an incident of domestic violence, even if the statement is testimonial in nature, as long as the statement bears sufficient indicia of reliability.

RELATING TO SEX TRAFFICKING. Authorizes a prosecution for sex trafficking to be commenced at any time.

RELATING TO SEX TRAFFICKING. Includes coercion as a means of committing the offense of sex trafficking.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

FAX: For testimony less than 5 pages in length, transmit to 808-586-6531 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or
WEB: For testimony less than 20MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
