RELATING TO PRESCRIPTION DRUG RATE SETTING. Establishes a prescription affordability commission within the Department of Commerce and Consumer Affairs to review prescription drug costs and establish levels of reimbursement. Appropriates moneys.

RELATING TO HEALTH CARE. Requires the Hawaii Health Authority to establish a five-year all-payer health care pilot program in a county with a population greater than 500,000. Requires certain payers to deposit contributions into the all-payer health care pilot program revolving fund, to be distributed to provider hospitals participating in the pilot program. Specifies budgetary requirements and calculation of fees for the pilot program. Requires reports to the legislature. Appropriates funds.

RELATING TO HEALTH INSURANCE. Establishes disclosure and consent requirements for nonparticipating health care providers. Prohibits nonparticipating health care providers from balance billing patients in specific circumstances. Establishes rate calculation requirements for reimbursement of nonparticipating providers.

RELATING TO MEDICAL SERVICE BILLING. Establishes billing requirements for unanticipated medical billing and unanticipated coverage gaps of patients for out-of-network emergency services received from non-participating providers. Specifies the circumstances in which health care providers and facilities can bill health carriers and enrollees for health intervention services that are medical necessities. Effective 1/1/2021.

RELATING TO ELECTRONIC SMOKING PRODUCTS. Establishes the offense of unlawful shipment of e-liquid products. Includes e-liquid and electronic smoking devices containing e-liquid within the definition of "tobacco products", as used in the cigarette tax and tobacco tax law. Allocates a portion of funds collected from excise taxes on tobacco products to health education and prevention programs about the risks and dangers of the use of electronic smoking devices for youth. Repeals certain provisions of the Hawaii Revised Statutes relating to electronic smoking devices.

RELATING TO FLAVORED TOBACCO PRODUCTS. Proposed HD1: Ban the sale of flavored tobacco products. Effective January 1, 2021.

RELATING TO THE SALE OF TOBACCO PRODUCTS. Proposed HD1: Establishes a schedule of penalties for employees and holders of retail tobacco permits or person registered to sell electronic cigarettes smoking devices who illegally sell tobacco products and electronic smoking device to persons under 21.

RELATING TO HEALTH. Prohibits the sale or furnishing of tobacco and tobacco products to persons under twenty-five years of age. Increases minimum age from twenty-one years of age to twenty-five years of age for purchase and possession of tobacco and tobacco products, including electronic smoking devices and increases fines.

RELATING TO CIGARETTES. Bans the sale of cigarettes and electronic cigarettes progressively by raising the minimum age of persons to whom cigarettes and electronic cigarettes may be legally sold to 30 years of age in 2021, 40 years of age in 2022, 50 years of age in 2023, 60 years of age in 2024, and then 100 years of age in 2025. Effective January 1, 2021.

RELATING TO HEALTH. Designates the month of September as Fetal Alcohol Spectrum Disorder Awareness Month to promote public awareness of the risks of alcohol consumption during pregnancy.

RELATING TO HEALTH. Establishes a task force within the Department of Health to identify therapies and home- and community-based care services that may benefit persons having fetal alcohol spectrum disorders, including therapies and treatments that may benefit them as adults. Requires the task force to recommend any necessary policy changes, rule changes, or legislation to increase access to these therapies and services. Requires a report to the Legislature.

RELATING TO HEALTH. Proposed HD1: Regulates cannabidiol under the department of health to be consistent with the Hawaii Food, Drug, and Cosmetic Act. Allows licensees under the industrial hemp pilot program to market their products to the consumer market in a manner that is regulated and tested for safety, purity, and potency.

RELATING TO MEDICAL CANNABIS. Allows for a process to remediate any batch of cannabis that fails laboratory testing standards so long as any final product passes all such laboratory standards. Authorizes licensed retail dispensaries to sell edible cannabis products, under certain conditions, and circulate, sponsor, and promote educational and scientific information and events related to cannabis.

RELATING TO MEDICAL CANNABIS PRODUCTS. Authorizes the manufacture and distribution of cannabis seeds and cannabis clones by medical cannabis dispensary licensees.

RELATING TO CANNABIS FOR MEDICAL USE. Authorizes dispensaries to distribute cannabis propagules and cuttings to individuals authorized to cultivate cannabis plants for medical use, subject to quantity limits and quality requirements.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
ˇ Testifier's name with position/title and organization;
ˇ The Committee(s) to which the comments are directed;
ˇ The date and time of the hearing; and
ˇ Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
