RELATING TO THE COMMISSION ON SALARIES. Requires the commission on salaries that convenes in 2024 to make salary recommendations for the following eight fiscal years. Provides for the executive, judicial, and legislative branch salary recommendations to become effective on the same date beginning on July 1, 2033. Takes effect on 7/1/2050.

RELATING TO THE JUDICIARY. Requires an appellate court to conduct a hearing when a conflict of interest pertaining to a judge or justice is alleged by motion of a party to any suit, action, or proceeding of the appellate court. Takes effect on 7/1/2050.

RELATING TO THE FAMILY COURT. Makes decisions of the family court appealable to the supreme court instead of the intermediate court of appeals. Requires the supreme court to render a final decision on appeals from family court orders within 180 days. Encourages a reduction in the number of remands to the family court. Takes effect on 7/1/2050.

RELATING TO IMMIGRATION. Makes an appropriation to the judiciary to contract with nonprofit organizations to provide legal assistance and legal counsel to immigrants in determining legal status and citizenship, provide diversion to existing services, and otherwise provide counsel for existing rights. Takes effect on 7/1/2050.

RELATING TO WITNESS FEES AND REIMBURSEMENTS IN CRIMINAL CASES. Clarifies applicable reimbursement to State or defendant for expert witness fees, as it pertains to testimony, preparation, and in-court attendance in state court criminal proceedings. Effective 7/1/2050.

MAKING AN APPROPRIATION TO THE OFFICE OF THE PROSECUTING ATTORNEY FOR THE COUNTY OF HAWAII. Appropriates funds for the career criminal prosecution unit of the office of the prosecuting attorney of the county of Hawaii. Takes effect on July 1, 2050.

RELATING TO CAMPAIGN FINANCE. Prohibits foreign nationals and foreign corporations from making independent expenditures. Requires every corporation that contributes or expends funds in a state election to file a statement of certification regarding its limited foreign influence. Requires noncandidate committees making only independent expenditures to obtain a statement of certification from each top contributor required to be listed in an advertisement. Takes effect on 7/1/2050.

RELATING TO ELECTIONS. Amends the assessment of administrative fines for persons and certain noncandidate committees making only independent expenditures that violate Hawaii's campaign finance laws. Allows the Campaign Spending Commission to order that payment of a fine assessed against a noncandidate committee, or any portion thereof, be paid from the personal funds of an officer of the noncandidate committee. Requires nomination paper filing fees to be deposited into the Hawaii election campaign fund. Increases the amount of public funds available to candidates who agree to expenditure limits beginning 1/1/2022. Increases the number of signatures and fees required to file nomination papers. Amends the deadline to file nomination papers to the first Tuesday in May. Takes effect on 7/1/2050.

RELATING TO ELECTIONS. Makes housekeeping amendments to Hawaii's elections laws to clarify and improve the administration of elections by mail. Establishes a process, beginning on January 1, 2021, for preregistering or registering public school- and charter school-enrolled students to vote. Establishes ranked choice voting for special federal elections and special elections of vacant county council seats. Amends filing deadlines for candidates attempting to fill vacant state senate seats.

RELATING TO DOMESTIC VIOLENCE. Allows a narrow hearsay exception for statements made by domestic violence victims to certain government officials within 24 hours of an incident of domestic violence, even if the statement is testimonial in nature, as long as the statement bears sufficient indicia of reliability. Effective 7/1/2050.

RELATING TO SEXUAL ASSAULT EVIDENCE COLLECTION KITS. Extends the deadline for the counties to adopt and utilize electronic tracking systems for sexual assault evidence collection kits. Takes effect on July 1, 2050.

RELATING TO SEX TRAFFICKING. Authorizes a prosecution for sex trafficking to be commenced at any time.

RELATING TO CHILDHOOD SEXUAL ABUSE. Amends statutory limitations on the time period in which a survivor of childhood sexual abuse may file a civil suit. Allows punitive damages up to two times the amount of compensatory damages. Permits the court to order restorative justice measures, if deemed appropriate. Takes effect on 7/1/2050.

RELATING TO SEX OFFENDERS. Allows a court to prohibit persons convicted of a crime against minors or sexual offense on 7/1/2020, and thereafter, from residing, permanently or temporarily, within 500 feet of any public or private school, child care facility, playground, or park where children may gather. Takes effect on 7/1/2050.

RELATING TO ELECTRIC VEHICLES. Authorizes each county to adopt ordinances to enforce section 291-71, Hawaii Revised Statutes, including through the establishment of penalties for failure to comply with its requirements or make reasonable efforts to maintain electric vehicle charging stations in working order. Clarifies that certain enforcement officers may enter private property to enforce electric vehicle parking space violations. Takes effect on 7/1/2050.

RELATING TO THEFT. Amends the offense of theft in the second degree to include theft of property commonly used to store items of personal or monetary value, including any purse, handbag, or wallet. Requires property owners to hold illegally parked bicycles found on their property for seven days. Provides that for the first offense of theft of a bicycle, a person shall be guilty of a misdemeanor, and, for the second and each subsequent offense, shall be guilty of a class C felony. Takes effect on 7/1/2050.

RELATING TO EMERGENCY WORKERS. Amends the definition of "emergency worker" in the Penal Code to include communications dispatchers. Takes effect on 7/1/2050.

RELATING TO NOTARIES PUBLIC. Updates the laws regarding notaries public to conform to the Revised Uniform Law on Notarial Acts (2018), the Hawaii Uniform Electronic Transactions Act, other state notary laws, and current notary practices. Takes effect on 7/1/2050.

RELATING TO PUBLIC ORDER. Establishes the offense of urinating or defecating in a public place within business districts. Takes effect on 7/1/2050.

RELATING TO FINANCIAL HARDSHIP. Expands the conditions for authorizing a restricted driver's license. Provides judges with greater discretion to adjust the amount owed by a person who violates certain traffic offenses based on the person's inability to pay. Decreases the imprisonment term to contumacious nonpayment ratio. Increases the amount of credit given to a person committed for contumacious nonpayment. Provides Hawaii residents with the option of paying for the registration of their motor vehicles and associated taxes and fees on a biannual basis. Restricts the amount of delinquency tax due to the current tax due plus one year. Removes language allowing storage costs and costs incident to seizure of a vehicle from inclusion in the amount the owner of a vehicle must pay in order to redeem the vehicle after seizure. Effective 7/1/2050.

RELATING TO PROPERTY FORFEITURE. Prohibits civil asset forfeiture unless the covered offense is a felony for which the property owner has been convicted. Excludes the forfeiture proceedings for an animal pending criminal charges. Requires the Attorney General to deposit the net proceeds of the forfeited property to the credit of the state general fund.

RELATING TO ANIMAL FUR PRODUCTS. Prohibits the manufacture and sale of animal fur products, with certain exceptions. Takes effect on 7/1/2050.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
