MAKING APPROPRIATIONS TO PROVIDE FOR THE EXPENSES OF THE LEGISLATURE, THE AUDITOR, THE LEGISLATIVE REFERENCE BUREAU, THE OMBUDSMAN, AND THE ETHICS COMMISSION. Proposed HD1: Appropriates funds to provide for the expenses of the Legislature, Auditor, Legislative Reference Bureau, Ombudsman, and Ethics Commission.

RELATING TO TAXATION. Proposed HD1: Extends the period in which a county may adopt a surcharge on state tax, under certain cnditions, from 3/31/2019 to 12/31/2020. Authorizes the use of county surcharge revenues for affordable housing infrastructure.

RELATING TO DISASTER RELIEF. Proposed HD2: Extends the lapse date of the appropriations made by Act 12, Session Laws of Hawaii 2018, to June 30, 2023, for flooding disaster relief for Kauai and other areas of the State . Effective 6/29/2020.

RELATING TO NON-GENERAL FUNDS. Reclassifies the antitrust trust fund, notaries public revolving fund, and criminal forfeiture revolving fund as special funds; litigation deposits trust fund as a trust account; and the national mortgage settlement trust account as a trust fund. Abolishes the criminal justice commission trust account.

RELATING TO PUBLIC SAFETY. Appropriates funds to purchase the Honolulu Federal Detention Center. Takes effect on 7/1/2050.

RELATING TO MEDICAL RELEASE. Creates a medical release program within the Department of Public Safety for certain ill, disabled, or impaired inmates who pose a low risk to public safety. Effective 7/1/2050. (HD2)

RELATING TO FIREWORKS. Increases the fireworks display permit fee from $110 to $150 and the fine for certain fireworks violations from $2,000 per violation to $5,000 per violation. Clarifies that each aerial device, display firework, or article pyrotechnic having a total weight of 25 pounds or less that is illegally imported, transferred, or sold constitutes a separate violation. Increases the penalty for removing or extracting the pyrotechnic contents. Takes effect on 7/1/2050. (HD1)

RELATING TO GOVERNMENT SERVICES. Clarifies the office of the legislative analyst.

RELATING TO OBSERVANCES. Requires the Legislative Reference Bureau to compile a report of the months and days of the year that have been designated by both chambers of the Legislature as a holiday or a period of recognition or observance within the State. Effective 10/19/2036. (HD1)

RELATING TO STATE PLANNING. Requires the office of planning to review and propose updates to the state planning act. Appropriates moneys. (HD1)

RELATING TO TOWING. Clarifies the fees tow companies may charge. Clarifies the duties of tow companies when vehicle owners arrive on the scene while their vehicles are in the process of being hooked up. Requires tow and storage companies to accept credit cards. Subjects violations of the towing statute to the penalties and remedies under the State's unfair or deceptive acts or practices law. Adds definitions for clarity. Effective 7/1/2050. (HD2)

RELATING TO GIFT CERTIFICATES. Clarifies that certain county-issued cards and certificates are not subject to the State's unfair and deceptive practices regulations related to gift certificates. Effective 7/1/2050. (HD1)

RELATING TO CEMETERIES. Clarifies that churches granted an exemption from the state laws governing cemeteries and funeral trusts are exempt from all requirements. Allows the director of commerce and consumer affairs to impose any statutory requirement upon an exempt cemetery authority by order. Clarifies that an entity exempt as a church under federal tax law is considered a church for purposes of exemption. Effective 7/1/2050. (HD1)

RELATING TO THE MORTGAGE LOAN RECOVERY FUND. Expands the pool of persons eligible to receive restitution from the Mortgage Loan Recovery Fund. Authorizes the Director of Commerce and Consumer Affairs to issue orders for restitution. Effective 7/1/2050. (HD2)

RELATING TO THE CONTRACTORS RECOVERY FUND. Increases the monetary amount an injured homeowner may recover from the Contractors Recovery Fund. Repeals 6/30/2023. Effective 7/1/2050.

RELATING TO ENHANCED 911 SERVICES. Establishes a prepaid wireless E911 surcharge to be imposed on prepaid wireless telecommunications services purchased at a retail transaction. Allows sellers to deduct and retain three per cent of the surcharge for administrative expenses. Requires deposit of the surcharge balance into the enhanced 911 fund. Amends the enhanced 911 surcharge rate. Effective 7/1/2050.

RELATING TO PROFESSIONAL AND VOCATIONAL LICENSING TRUST FUNDS. Allows the Contractors License Board and Real Estate Commission to adjust, reduce, suspend, or cease collection of recovery fund and education fund fees to maintain a reasonable relation between the fees generated and the cost of services rendered by the funds. Effective 7/1/2050.

· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
