Amends certain land subdivision and condominium property regime laws related to agricultural land, as recommended pursuant to Act 278, Session Laws of Hawaii 2019, to ensure condominium property regime projects within the agricultural district are used for agricultural purposes.  Effective 7/1/2050.  (HD1)

RELATING TO CEMETERY AUTHORITY EXEMPTION.

Clarifies that churches granted an exemption under section 441-22.1, Hawaii Revised Statutes, are exempt from all requirements of chapter 441, Hawaii Revised Statutes, and that other exempted entities shall comply with any provision of this chapter upon order of the director of commerce and consumer affairs.  Effective 7/1/2050.  (HD1)

Requires the governor; DBEDT; and Hawaii state energy office to develop a strategic plan that outlines benchmarks to help achieve the statutory renewable portfolio standard goals and zero emissions clean economy target.  Requires the Hawaii state energy office to submit the strategic plan before the Regular Session of 2022.  Requires the chief energy officer to convene an advisory group.  Appropriates funds.  Effective 7/1/2050.  (HD1)

Beginning 7/1/2021:  bans the manufacture of a personal care product, except a non-prescription drug, that contains synthetic plastic microbeads.  Beginning 7/1/2022:  bans the sale or offer for sale of a personal care product, except a non-prescription drug, that contains synthetic plastic microbeads and bans the manufacture of a non-prescription drug that contains synthetic plastic microbeads.  Beginning 7/1/2023:  bans the sale or offer for sale of a non-prescription drug that contains synthetic plastic microbeads.  Specifically exempts rinse-off cosmetics and rinse-off cosmetics that are also non-prescription drugs regulated by the federal Microbead-Free Waters Act of 2015.  Effective on 7/1/2050.  (HD1)

RELATING TO INDIVIDUAL WASTEWATER SYSTEMS.

Establishes the time of transfer individual wastewater system inspection program to oversee the inspection and repair of any individual wastewater system at the time of the property's sale or transfer.  Excludes certain sales or transfers.  Effective 7/1/2050.  (HD1)

RELATING TO THE DEPOSIT BEVERAGE CONTAINER PROGRAM.

Requires the department of health to implement the auditor's recommendations for the deposit beverage container program, including developing a risk-based selection process to select reports submitted by distributors and redemption centers for audit.  Effective 7/1/2050.  (HD1)

RELATING TO RENEWABLE ENERGY.

Requires the Public Utilities Commission to contract with HNEI to conduct an independent renewable gas study.  Appropriates funds from the Public Utilities Commission Special Fund.  Amends the definition of renewable portfolio standard to be a percentage of electrical energy generation, rather than sales.  Effective 7/1/2050. (HD1)

RELATING TO RENEWABLE ENERGY TECHNOLOGIES TAX CREDITS.

Repeals the renewable energy technologies income tax credit for solar energy systems installed and placed in service for commercial properties that require a power purchase agreement (PPA) approved by the PUC, except for certain solar energy systems.  Increases the renewable energy technologies income tax credit cap amount for multi-family residential properties.  Effective 7/1/2050.  (HD1)

Status

RELATING TO CONSUMER PROTECTION.

Establishes regulatory framework for small dollar lenders in article 9 of chapter 412, HRS.  Specifies various consumer protection requirements for small dollar loans.  Beginning 1/1/2022, requires licensure for small dollar lenders that offer small dollar loans to consumers.  Specifies licensing requirements for small dollar lenders.  Authorizes the division of financial institutions to appoint 2.0 FTE examiner positions, funded via the compliance resolution fund, to carry out the purposes of the small dollar installment loan program.  Requires check cashers to be registered with DCCA and to offer a voluntary payment plan to customers under certain circumstances.  Establishes the terms of voluntary payment plans.  Clarifies that a customer may only have one outstanding deferred deposit transaction from any source.  Amends notices to customers required of check cashers.  Removes the exemption for persons engaged in the bona fide retail sale of goods or services.  Requires the Auditor to conduct an analysis of the regulation of payday lenders and deferred deposit agreements in the State.  Effective 7/1/2050.  (HD1)
