Repeals section 46-19.8, Hawaii Revised Statutes, thereby allowing counties to regulate installation of residential fire protection sprinkler systems.

RELATING TO PHARMACY BENEFIT MANAGERS.

Establishes business practice and transparency reporting requirements for pharmacy benefit managers.  Replaces the registration requirement for pharmacy benefit managers with a licensing requirement.  Increases penalties for violations of the pharmacy benefit managers law.  Effective 7/1/2050.  (HD1)

Status

RELATING TO MEDICAL CANNABIS.

Allows for a process to remediate any batch of cannabis that fails laboratory testing standards so long as any final product passes all such laboratory standards.  Authorizes licensed retail dispensaries to sell edible cannabis products, under certain conditions, and circulate, sponsor, and promote educational and scientific information and events related to cannabis.  Effective 7/1/2050.  (HD1)

RELATING TO FLAVORED TOBACCO PRODUCTS.

Bans the sale of flavored tobacco products, except for menthol and liquid or like substances with a distinguishable taste or aroma of tobacco or menthol.  Prohibits the mislabeling, sale, or marketing as nicotine-free any e-liquid product that contains nicotine.  Specifies penalties for violations.  Takes effect on 7/1/2050.  (HD1)

RELATING TO THE SALE OF TOBACCO PRODUCTS.

Establishes a schedule of penalties for employees and holders of retail tobacco permits or persons registered to sell electronic cigarette smoking devices who illegally sell tobacco products and electronic smoking devices to persons under 21.  Effective July 1, 2050.  (HD1)

RELATING TO HEALTH.

Explicitly recognizes advanced practice registered nurses as attending providers and consulting providers capable of performing all necessary duties under the Our Care, Our Choice Act in accordance with their scope of practice and prescribing authority.  Reduces the mandatory waiting period between oral requests made by a terminally ill individual from twenty to fifteen days.  Allows an attending provider to waive the waiting period for terminally ill individuals not expected to survive the mandatory waiting period.  Effective 7/1/2050.  (HD1)

Authorizes medical cannabis dispensaries to distribute cannabis propagules and cuttings to individuals authorized to cultivate cannabis plants for medical use, subject to quantity limits and quality requirements.  Effective 7/1/2050.  (HD1)

Status

RELATING TO HOMEOWNERS' ASSOCIATIONS.

Authorizes the creation of community associations that are not subject to the laws relating to planned community associations.  Authorizes the creation of entities to collect contributions or homeowners' association dues or be responsible for the maintenance of common areas such as private roads or parks if the common-interest community subdivisions were created without those entities.  Authorizes counties to hear, administer, and decide certain disputes.  Appropriates funds to the counties.

Status

RELATING TO INTOXICATING LIQUOR.

Exempts applications for a class 1 license on land designated as agricultural by state or county zoning laws and for which the majority of the agricultural products used in the manufacturing of the liquor are grown and produced in the State by the license holder from the automatic refusal provision that may be invoked by a majority of nearby voters or real estate owners.

RELATING TO DOMESTIC ABUSE.

Amends the definition of domestic abuse under Hawaii's insurance laws and domestic abuse protective order statutes to include coercive control between family or household members.  Defines coercive control.

Status

RELATING TO A PILOT PROGRAM FOR DAILY ELECTRONIC REPORTING OF PAWNBROKER AND SECONDHAND DEALER TRANSACTIONS.

Requires the Maui County Police Department to implement a 5-year pilot program for the daily electronic reporting of pawnbroker and dealer transactions.  Requires interim and final reports to the Legislature.  Appropriates funds.
