     Your Committees on Lower & Higher Education and Labor & Public Employment, to which was referred S.B. No. 3058, S.D. 2, entitled:

 

"A BILL FOR AN ACT RELATING TO TECHNOLOGY TRANSFER AT THE UNIVERSITY OF HAWAII,"

 

beg leave to report as follows:

 

     The purpose of this measure is to extend the availability of certain exemptions from the State Ethics Code regarding technology transfer activities sponsored by the University of Hawaii to June 30, 2025.

 

     Your Committees received testimony in support of this measure from the University of Hawaii System and one individual.

 

     Your Committees find that Act 38, Session Laws of Hawaii 2017 (Act 38), clarified and updated the application of the State Ethics Code to technology transfer activities sponsored by the University of Hawaii, which facilitated the University's contributions to research commercialization and economic development.  However, a sunset date of June 30, 2022, was included in Act 38.  Your Committees further find that it is a matter of statewide concern to support the timely and efficient commercialization of intellectual property created by basic and applied research at the University of Hawaii, and that extending Act 38 will allow the University to continue its contribution to research commercialization and economic development.

 

Your Committees have amended this measure by:

 

     (1)  Changing the effective date to July 1, 2051; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the records of votes of the members of your Committees on Lower & Higher Education and Labor & Public Employment that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 3058, S.D. 2, as amended herein, and recommend that it pass Second Reading in the form attached hereto as S.B. No. 3058, S.D. 2, H.D. 1, and be referred to your Committee on Judiciary.
