Sir:
Your Committee on Finance, to which was referred S.B. No. 2844, S.D. 2, H.D. 1, entitled:
"A BILL FOR AN ACT MAKING APPROPRIATIONS FOR CLAIMS AGAINST THE STATE, ITS OFFICERS, OR ITS EMPLOYEES,"
begs leave to report as follows:
The
purpose of this measure is
to satisfy several claims against the State, its officers, or its employees.
Your
Committee has amended this measure by:
(1) Incorporating the claim and settlement amount from S.B. No. 3180, S.D. 1, which provided funds for the State Public Charter School Commission pursuant to Miller-Potter v. State of Hawaii, et al., Civil No. 16-1-0385K;
(2) Adding an additional claim of $40,000 pursuant to the settlement of Lana v. State of Hawaii, et al., Civil No. 13-1-2365-08, to be paid from operating funds from the Department of Public Safety;
(3) Specifying that funds appropriated by Act 5, Session Laws of Hawaii 2019, to the programs referenced in this measure that are not expended or encumbered for the specific purposes described in this measure as of June 30, 2021, shall lapse;
(4) Specifying that the measure shall take effective retroactively to June 30, 2020; and
(5) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Finance that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 2844, S.D. 2, H.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 2844, S.D. 2, H.D. 2.
