Sir:

 

     Your Committee on Judiciary, to which was referred S.B. No. 2844, S.D. 2, entitled:

 

"A BILL FOR AN ACT MAKING APPROPRIATIONS FOR CLAIMS AGAINST THE STATE, ITS OFFICERS, OR ITS EMPLOYEES,"

 

begs leave to report as follows:

 

     The purpose of this measure is to satisfy several claims against the State, its officers, or its employees.

 

     Your Committee received testimony in support of this measure from the Department of the Attorney General, Hawaii Community Development Authority, Hawaii State Public Library System, and one individual.  Your Committee received comments on this measure from one individual.

 

Your Committee finds that the Department of the Attorney General testified that it has advised its client agencies on how to avoid claims such as those included in this measure.

 

                Your Committee has amended this measure by:

 

     (1)  Appropriating $40,000 in general funds for a settlement in the case of Lau, et al. v. Kenui, et al., Civil No. 17-1-0209, Third Circuit;

 

     (2)  Appropriating $350,000 in general funds for a settlement in the case of Firth, et al. v. County of Maui, et al., Civil No. 18-1-0234(4), Second Circuit;

 

     (3)  Appropriating $55,000 in general funds for a settlement in the case of Carolyn Ward Aki v. City and County of Honolulu, et al., Civil No. 17-1-1861-11 GWBC, First Circuit;

 

     (4)  Appropriating $143,990 in general funds for a settlement in the case of United States Environmental Protection Agency, Region 9 - Hawaii State Public Library System;

 

     (5)  Appropriating $71,594.18 in general funds for a judgment in the case of HGEA/AFSCME on Behalf of Ardith Renteria, and Charter Volcano School of Arts and Sciences;

 

     (6)          Appropriating $2.01 in general funds for a claim by Loretta Beralas;

 

     (7)          Appropriating $16,000 in general funds for a claim by BVT-CAM Private Equity Global Fund II Beteiligungs GmbH;

 

     (8)          Appropriating $51,300 in general funds for a claim by CAM Private Equity Verwaltungs GmbH;

 

     (9)          Appropriating $42,500 in general funds for a claim by CAM Select I Beteiligungs GmbH;

 

     (10)     Appropriating $23,125 in general funds for a claim by Amanda Jamieson;

 

     (11)     Appropriating $23,125 in general funds for a claim by Margaret Jamieson;

 

     (12)     Appropriating $93.93 in general funds for a claim by Nanci J. Merck;

 

     (13)     Appropriating $1,023.99 in general funds for a claim by Betty Y. Ohigashi;

 

     (14)     Appropriating $578.40 in general funds for a claim by the Estate of Calvin C. Ontai;

 

     (15)     Appropriating $1,000 in general funds for a claim by Elaine S. Tanigawa;

 

     (16)     Appropriating $388.19 in general funds for a claim by Christine Woods;

 

     (17) Changing the effective date to upon approval; and

 

     (18) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 2844, S.D. 2, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 2844, S.D. 2, H.D. 1, and be referred to your Committee on Finance.
