     Your Committee on Water, Land, & Hawaiian Affairs, to which was referred S.B. No. 2701 entitled:

 

"A BILL FOR AN ACT RELATING TO AGRICULTURAL BUILDINGS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to grant county agencies the right to enter property to investigate agricultural buildings, structures, and appurtenances for violations of, and compliance with, building permit and building code exemption requirements.

 

     Your Committee received testimony in support of this measure from the Office of Planning, Office of the Mayor of the County of Hawaii, Hawaii Cattlemen's Council, and Hawaii Farm Bureau.  Your Committee received testimony in opposition to this measure from one individual.  Your Committee received comments on this measure from the Department of Agriculture.

 

     Your Committee finds that existing law exempts certain types of agricultural buildings, structures, and appurtenances from building permit and building code requirements.  However, your Committee also finds that agricultural buildings, structures, and appurtenances are sometimes illegally used for residential purposes.  This measure explicitly grants county agencies the authority to exercise their enforcement powers and help prevent the misuse of agricultural buildings, structures, and appurtenances that are exempt from building permit and building code requirements.

 

     Your Committee has amended this measure by changing the effective date to July 1, 2050, to encourage further discussion.

 

     As affirmed by the record of votes of the members of your Committee on Water, Land, & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 2701, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 2701, H.D. 1, and be referred to your Committee on Judiciary.
