Sir:

 

     Your Committee on Judiciary, to which was referred S.B. No. 2612, S.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO SPORTS OFFICIALS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to allow a court to enjoin a defendant convicted of certain assault or terroristic threatening offenses from attending certain sports events for a period of up to twelve months if the victim of the offense is a sports official engaged in the lawful discharge of the sports official's duties.

 

     Your Committee received testimony in support of this measure from the Department of Education and Hawaii Scholastic Soccer Federation.  Your Committee received comments on this measure from the Office of the Public Defender.

 

     Your Committee finds that there is a shortage of sports officials in Hawaii.  Your Committee further finds that unruly spectators and fans are a contributing factor to this shortage, especially when there are threats of bodily harm and assault against sports officials.  This measure will deter these kinds of threats and assault against sports officials.


     Your Committee has amended this measure by:

 

     (1)  Allowing a court to enjoin a defendant for life for a second or subsequent offense; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 2612, S.D. 1, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 2612, S.D. 1, H.D. 1, and be placed on the calendar for Third Reading.
