Sir:

 

     Your Committee on Water, Land, & Hawaiian Affairs, to which was referred H.C.R. No. 30 entitled:

 

"HOUSE CONCURRENT RESOLUTION AUTHORIZING THE ISSUANCE OF TERM, NON-EXCLUSIVE EASEMENTS COVERING PORTIONS OF STATE SUBMERGED LANDS AT WAIOHULI-KEOKEA, WAILUKU, MAUI, FOR THE EXISTING SEAWALL, AND FOR THE USE, MAINTENANCE, AND REPAIR OF THE EXISTING IMPROVEMENTS CONSTRUCTED THEREON,"

 

begs leave to report as follows:

 

     The purpose of this measure is to authorize the issuance of term, non-exclusive easements covering a portion of state submerged lands at Waiohuli-Keokea, Wailuku, Maui, for the existing seawall, and for use, repair, and maintenance of existing improvements constructed thereon.

 

     Your Committee received testimony in support of this measure from the Department of Land and Natural Resources.

 

     Your Committee finds that in 2015, a term, non-exclusive easement was issued to a private property owner for an existing seawall located in Waiohuli-Keokea that was placed on state submerged lands.  Your Committee further finds it was later discovered that there were additional portions of the seawall that encroached upon state submerged lands that were not covered by the 2015 easement and the existing easement must be amended to include these newly identified portions of the seawall.  This measure authorizes the amendment of the existing easement for the identified state submerged lands in Waiohuli-Keokea to cover the additional areas encroached on by portions of the seawall.

 

     Your Committee has amended this measure by making a technical, nonsubstantive amendment for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Water, Land, & Hawaiian Affairs that is attached to this report, your Committee concurs with the intent and purpose of H.C.R. No. 30, as amended herein, and recommends that it be referred to your Committee on Finance in the form attached hereto as H.C.R. No. 30, H.D. 1.
