Sir:

 

     Your Committee on Judiciary, to which was referred H.B. No. 2737 entitled:

 

"A BILL FOR AN ACT RELATING TO FIREWORKS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to:

 

     (1)          Increase the fireworks display permit fee from $110 to $150 and the fine for certain fireworks violations from $2,000 per violation to $5,000 per violation;

 

     (2)          Clarify that each aerial device, display firework, or article pyrotechnic having a total weight of twenty-five pounds or less that is illegally imported, transferred, or sold constitutes a separate violation; and

 

     (3)          Increase the penalty for removing or extracting pyrotechnic contents.

 

     Your Committee received testimony in support of this measure from the Hawaii State Fire Council, Honolulu Fire Department, Hawaii Fire Department, and one individual.  Your Committee received testimony in opposition to this measure from one individual.

 

     Your Committee finds that this measure will implement recommendations made by the Illegal Fireworks Task Force established by Act 170, Session Laws of Hawaii 2010.  Your Committee further finds that raising permit fees and fines is one means of deterring the use of illegal fireworks, decreasing their supply in the State, and increasing funding for prevention and enforcement efforts.

 

     Your Committee has amended this measure by:

 

     (1)  Changing its effective date to July 1, 2050, to encourage further discussion; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2737, as amended herein, and recommends that it be referred to your Committee on Finance in the form attached hereto as H.B. No. 2737, H.D. 1.
