Sir:
Your Committee on Water, Land, & Hawaiian Affairs, to which was referred H.B. No. 2588 entitled:
"A BILL FOR AN ACT RELATING TO THE HAWAIIAN HOMES COMMISSION ACT,"
begs leave to report as follows:
The purpose of this measure is to prohibit lessees who sell or transfer their interest in a Hawaiian home lands tract from obtaining a subsequent lease for the same class of land, with certain exceptions.
Your
Committee finds that certain Native Hawaiians who have qualified for and
acquired a Hawaiian homelands lease have subsequently sold or transferred their
interest in the lease, then placed their name on the waitlist for a second
lease of Hawaiian homelands. This
practice has contributed to many otherwise eligible Native Hawaiians never
receiving a lease offer. This measure
seeks to address this issue by prohibiting lessees who sell or transfer their interest
in a Hawaiian homelands tract from obtaining a subsequent lease for the same
class of land, except in certain situations.
Your Committee has amended this measure by:
(1) Changing the effective date to July 1, 2050, to encourage further discussion; and
(2) Making a technical, nonsubstantive amendment for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Water, Land, & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2588, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2588, H.D. 1, and be referred to your Committee on Judiciary.
