Sir:

 

     Your Committee on Intrastate Commerce, to which was referred H.B. No. 2316 entitled:

 

"A BILL FOR AN ACT RELATING TO THE CONTRACTORS RECOVERY FUND,"

 

begs leave to report as follows:

 

     The purpose of this measure is to increase the maximum monetary amount that an injured homeowner may recover under the Contractors Recovery Fund.

 

     Your Committee received testimony in support of this measure from the Contractors License Board and Subcontractors Association of Hawaii.

 

     Your Committee finds that the Contractors Recovery Fund provides financial assistance to homeowners injured by the act, representation, transaction, or conduct of a licensed contractor.  This measure will enhance an injured homeowner's relief from the homeowner's financial loss resulting from such act, representation, transaction, or conduct.

 

     Your Committee has amended this measure by:

 

     (1)  Changing the maximum liability payout for a licensed contractor under the Contractors Recovery Fund from $75,000 to $50,000; and

 

     (2)  Changing the effective date to July 1, 2050, to encourage further discussion.

 

     As affirmed by the record of votes of the members of your Committee on Intrastate Commerce that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2316, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2316, H.D. 1, and be referred to your Committee on Consumer Protection & Commerce.
