Sir:

 

     Your Committee on Labor & Public Employment, to which was referred H.B. No. 2286 entitled:

 

"A BILL FOR AN ACT RELATING TO EMERGENCY PROCUREMENT,"

 

begs leave to report as follows:

 

     The purpose of this measure is to broaden the Procurement Code authority for emergency procurements by:

 

     (1)  Adding equipment failures, repairs to public property to protect against further loss of, or damage to public property, to prevent or minimize serious disruption in continued functioning of government services to the emergency procurement conditions; and

 

     (2)  Replacing chief procurement officer approval with an accounting report to the Legislature within sixty days after the end of the fiscal year in which the procurement was made.

 

     Your Committee received testimony in support of this measure from the Department of Transportation and Department of Agriculture.  Your Committee received comments on this measure from the Department of Accounting and General Services and State Procurement Office.

     Your Committee finds that this measure allows for greater discretion to those with purchasing power within an agency to address emergency situations as they arise.

 

Your Committee has amended this measure by:

 

     (1)  Clarifying the emergency procurement conditions;

 

     (2)  Changing the reporting requirement to the Legislature to an unspecified time after the procurement was made;

 

     (3)  Inserting an effective date of January 1, 2050, to encourage further discussion; and

 

     (4)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Labor & Public Employment that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2286, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2286, H.D. 1, and be referred to your Committee on Finance.
