Sir:

 

     Your Committee on Water, Land, & Hawaiian Affairs, to which was referred H.B. No. 1928 entitled:

 

"A BILL FOR AN ACT RELATING TO DEVELOPMENT DISTRICTS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to:

 

     (1)  Establish the Pulehunui Community Development District on the island of Maui as a community development district within the authority of the Hawaii Community Development Authority; and

 

     (2)  Authorize the Hawaii Community Development Authority to obtain various forms of financial aid from the federal government for projects of the authority.

 

     Your Committee received testimony in support of this measure from the Department of Public Safety, Department of Hawaiian Home Lands, Office of the Mayor of the County of Maui, and one member of the Maui County Council.  Your Committee received comments on this measure from the Department of Land and Natural Resources and Hawaii Community Development Authority.

 

     Your Committee finds that there are four underutilized parcels of public land located in Pulehunui that are appropriate for development.  Your Committee further finds that there are federal funding opportunities that may result in federal financial assistance for development of the Pulehunui public lands as well as other community development districts in the State.

 

     Your Committee recognizes that three community development districts created by law and overseen by the Hawaii Community Development Authority are all located on the island of Oahu; as the proposed Pulehunui community development district is located on the island of Maui, your Committee believes that the district will be better served by an autonomous authority administratively attached to the Hawaii Community Development Authority (HCDA).

 

     Your Committee has amended this measure by:

 

     (1)  Establishing the Pulehunui Community Development Authority as an autonomous community development authority under HCDA for administrative purposes;

 

     (2)  Adding two community representatives from the island of Maui and the Executive Director of HCDA, or the Executive Director's designee, to the Pulehunui Community Development Authority as voting members;

 

     (3)  Making the Director of Finance and the Adjutant General, or their designees, ex officio, nonvoting members of the Pulehunui Community Development Authority and removing the Chairperson of the Hawaiian Homes Commission, or designee, as an ex officio, nonvoting member of the Authority;

 

     (4)  Specifying that the Pulehunui Community Development Authority shall annually elect a chairperson and vice chairperson from among its members, adding a provision for reimbursement of expenses for members, and specifying determination of quorum, majority, and voting authority for members;

 

     (5)  Requiring the Pulehunui Community Development Authority and Comptroller to execute a memorandum of agreement for matters affecting the Pulehunui Community Development District, and requiring the Executive Director of HCDA to execute a memorandum of agreement with appropriate state agencies for matters affecting TMK 2-3-8-008-37;

 

     (6)  Inserting an appropriation of an unspecified sum, for two full-time equivalent (2.00 FTE) positions;

 

     (7)  Changing the effective date to July 1, 2050, to encourage further discussion; and

 

     (8)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Water, Land, & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1928, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1928, H.D. 1, and be referred to your Committee on Finance.
