Sir:

 

     Your Committee on Transportation, to which was referred H.B. No. 1808 entitled:

 

"A BILL FOR AN ACT RELATING TO MOTOR VEHICLES,"

 

begs leave to report as follows:

 

     The purpose of this measure is to allow the county directors of finance to issue certificates of ownership and salvage certificates to facilitate the disposition of abandoned vehicles in the State under specified circumstances.

 

Your Committee received testimony in support of this measure from Insurance Auto Auctions, Inc.  Your Committee received comments on this measure from the Department of Commerce and Consumer Affairs and Hawaii Insurers Council.

 

     Your Committee finds that abandoned vehicles are unnecessarily accumulating at salvage facilities as a result of owners filing claims with insurance companies and then abandoning the vehicle without completing a title transfer.  This measure establishes an expedited process to assist in the transition of ownership of salvaged vehicles between policyholders and insurers.


     Your Committee has amended this measure by:

 

     (1)  Removing the provision that requires the insurance company to indemnify county directors of finance from liability resulting from the issuance of a certificate of ownership or salvage certificate to the insurance company; and

 

     (2)  Changing the effective date to July 1, 2050, to encourage further discussion.

 

     As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1808, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1808, H.D. 1, and be referred to your Committee on Consumer Protection & Commerce.
