Sir:
Your Committee on Judiciary, to which was referred H.B. No. 1793 entitled:
"A BILL FOR AN ACT RELATING TO THE COMMISSION ON SALARIES,"
begs leave to report as follows:
The purpose of this measure is to amend when recommendations by the Commission on Salaries are effective.
Your Committee received comments on this measure from the Judiciary.
Your
Committee finds that salaries recommended by the Commission on Salaries
currently take effect at staggered times.
Under article XVI, section 3.5 of the Hawaii State Constitution, the
Commission reviews and recommends "salaries for the justices and judges of
all state courts, members of the [L]egislature," Governor and Lieutenant
Governor, and specified appointed officials within the State executive
branch. However, recommended salaries
currently take effect in a staggered timeline.
Your
Committee finds that all salary recommendations should become effective at the
same time. Your Committee further finds
that this measure will not affect when the Commissions submit their recommendations
and dissolve, which will still occur every six years in accordance with the
Hawaii State Constitution. Rather this
measure will require that recommendations take effect simultaneously at a later
date.
Your Committee has amended this measure by:
(1) Changing the effective date to July 1, 2050, to encourage further discussion; and
(2) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1793, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1793, H.D. 1, and be referred to your Committee on Finance.
