Sir:

 

     Your Committee on Judiciary, to which was referred H.B. No. 1785 entitled:

 

"A BILL FOR AN ACT RELATING TO THE JUDICIARY,"

 

begs leave to report as follows:

 

     The purpose of this measure is to appropriate supplemental funds for the operating and capital improvement budget of the Judiciary for fiscal years (FY) 2019-2020 and 2020-2021.

 

     The Judiciary submitted a supplemental operating budget that totaled:

 

                          FY 2019-2020     FY 2020-2021

General Funds              $171,819,204      $172,725,846

All Means of Financing      $184,626,379      $185,533,021

 

     The Judiciary submitted a capital improvement budget that totaled:

 

                          FY 2019-2020     FY 2020-2021

General Obligation Bonds      $9,355,000       $27,700,000


     Your Committee received testimony in support of this measure from the Judiciary, Hawaii State Bar Association, Kauai Bar Association, Volunteer Legal Services Hawaii, Legal Aid Society of Hawaii, and two individuals.

 

     Your Committee finds that the operating and capital improvement budget of the Judiciary is necessary to maintain the integrity of the courts and fulfill the Judiciary's statutory, constitutional, and public service mandates.

 

     Your Committee has amended this measure by:

 

     (1)  Changing the appropriations for capital improvement projects and the issuance of general obligation bonds to unspecified amounts;

 

     (2)  Changing the effective date to July 1, 2050, to encourage further discussion; and

 

     (3)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     Should your Committee on Finance decide to hear this measure, your Committee respectfully requests that it consider appropriating $37,055,000 in sections 3 and 4 of this measure for the Judiciary's capital improvement projects.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1785, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1785, H.D. 1, and be referred to your Committee on Finance.
